Our Costs Budgeting and Management services are designed to help you and your client control and manage your legal costs throughout your case, ensuring that they remain proportionate and transparent at all stages.
We bring extensive experience to this complex and technical area of litigation. From the outset, we act as part of your litigation team. We assist with preparing the initial Precedent H court budget, based on detailed discussions with you about how the case is likely to unfold. We also calculate and include any ‘incurred’ costs, and review the draft with you to ensure it is accurate and ready for filing and service.
After the Precedent H has been served, we can negotiate with all parties involved to reach an agreement on the court budgets, or provide expert advice on any cost claims. Once negotiations are complete, we prepare the Precedent R Discussion Report for filing at court.
If an agreement cannot be reached on the budgets, we are fully equipped to represent you at the Costs Management Conference (CMC), either by conducting advocacy or assisting your legal team or counsel.
Following successful negotiations or the issuance of a Costs Management Order (CMO) at the CMC, we will prepare and submit the amended and fully compliant Precedent H to court.
Should it emerge that costs may exceed the approved budget, it’s essential that you apply for a variation of budget before that happens. This requires demonstrating a good reason to depart from Precedent T. We’re here to guide you through this process, assisting with the preparation of the Precedent T and the necessary steps to request an increase in your costs budget.
